Recently in an interview, the Chairman of RERA Karnataka, Mr. Kamble, a retired IAS Officer has himself admitted to the teething troubles affecting the proper implementation of RERA in Karnataka. People are questioning over the effective implementation of RERA in Karnataka as it took nearly two years to have a permanent authority with a full-fledged implementation of the Act and realization of its objectives is still elusive.
Mr. Kamble admits to the ineffectiveness of the system and mistake on their part. A vital part of RERA is yet to be implemented in Karnataka RERA which is Agreement of Sale. The agreement of sale is the most important aspect of RERA as it ensures the protection of consumer rights of buyers, as builders are mandated to disclose the carpet area and built-up area separately in the document and charge only for the built-up area.
The chairman clarifies that the discussions are going on to adopt the format prescribed by the Centre for the agreement of sale or to come up with its own format. He justifies that the concept of RERA is something new to Indian society as well as the administrative system, therefore, time is required to hold the pace. There are some technical gaps on the web portal of Karnataka RERA which will be monitored soon from the team of National Informatics Centre (NIC). Although there is a team to monitor the advertisements of projects to know whether the projects are registered or not, work is being conducted at a slow pace.
A panel of Chartered Accountants is yet to be set up to scrutinize the quarterly updates filed by the builders.
